This Privacy Policy explains how EdFill, doing business as EdFill (“EdFill,” “Company,” “we,” “us,” or “our”), collects, uses, discloses, stores, and protects information when you access or use the EdFill website, application, AI-powered educational content tools, assignment tools, export and download tools, student-facing features, subscription services, credit system, integrations, and related services (collectively, the “Service”).
For purposes of this Privacy Policy:
“School” means a school, school district, educational institution, homeschool organization, tutoring organization, teacher, administrator, parent, guardian, or other authorized educational organization or adult that provides, assigns, administers, supervises, or controls access to the Service for students.
“Student User” means a student, child, minor, learner, or other individual who accesses or uses the Service under the direction, authorization, control, or supervision of a School, parent, guardian, educator, tutor, or other authorized adult.
“Student Data” means personal information, education records, student account information, student identifiers, roster information, assignment responses, grades, performance data, progress data, classroom data, or other information directly related to an identifiable Student User that is provided to EdFill by or on behalf of a School, parent, guardian, educator, tutor, or authorized adult.
“Exports and Outputs” means any content, materials, files, documents, worksheets, answer keys, assignments, reports, presentations, downloads, print-ready files, PDFs, Google Docs exports, Google Slides exports, third-party exports, integration-based exports, and any other output formats created, generated, downloaded, exported, shared, assigned, displayed, or made available through the Service.
By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, do not use the Service.
1. SCOPE AND ROLES
This Privacy Policy applies to information we collect through the Service, including account registration, adult and organizational accounts, student-facing features, educational content creation, AI generation, assignments, student responses, Exports and Outputs, uploaded or pasted source materials, payment and subscription activity, website and app usage, support communications, integrations, beta features, and related tools.
For individual adult users, EdFill generally determines the purposes and means of processing personal information, subject to applicable law. When the Service is used by or on behalf of a School or organization and Student Data is provided or authorized by that School or organization, EdFill generally processes Student Data on behalf of and at the direction of that School or organization, subject to applicable law, this Privacy Policy, our Terms of Use, and any applicable written agreement.
This Privacy Policy does not apply to third-party websites, services, platforms, payment processors, AI providers, integrations, export destinations, or links that we do not control, except where we describe how we share information with those providers to operate the Service.
2. IMPORTANT NOTE ABOUT STUDENT DATA
EdFill is designed for use by adult educators, tutors, homeschoolers, parents, Schools, districts, and other authorized users to create educational materials and, where enabled, provide online assignments or student-facing educational activities.
When EdFill is used by a School, district, teacher, parent, guardian, tutor, or other authorized adult to provide student-facing features, EdFill may collect or process Student Data.
We treat Student Data as confidential and use Student Data as described in this Privacy Policy, our Terms of Use, user settings, product settings, applicable written agreements, and applicable law. This may include using Student Data to provide, maintain, secure, support, improve, and operate the Service; support online assignments and student-facing features; comply with legal obligations; enforce agreements; prevent fraud, abuse, or security threats; maintain backups and records; and create de-identified, anonymized, or aggregated data.
EdFill does not require users to submit unnecessary Student Data to create educational materials. Users should use the minimum amount of Student Data necessary and should avoid including sensitive student information unless authorized and necessary.
3. INFORMATION WE COLLECT
We may collect the following categories of information depending on how the Service is used:
Account, profile, and organization information, such as name, email address, login credentials, account role, organization or School affiliation, profile settings, communication preferences, plan type, usage limits, subscription and credit information, accepted policy version history, account status, administrative settings, license or seat information, purchasing information, and support communications.
Student account and activity information, if student-facing features are enabled, such as student name, display name, username, account identifier, email address if used, classroom or roster association, grade level, access methods, School or teacher association, account status, role, permissions, assignment activity, responses, submissions, scores, feedback, progress, timestamps, and activity logs.
Educational content, prompts, source materials, and generated materials, such as prompts, instructions, educational settings, user-edited content, generated content, answer keys, explanations, images, diagrams, visual content, formatting and export preferences, metadata, revision history, regeneration history, downloads, exports, uploaded documents, text excerpts, images, files, screenshots, extracted text, and processing history.
Usage, device, log, and diagnostic information, such as pages viewed, features used, actions taken, content generated, assignments created, student activity events, credit usage, session activity, login times, error logs, browser type, device type, operating system, IP address, approximate location derived from IP address, referring URLs, performance data, diagnostic data, security logs, interaction patterns, rate-limit data, abuse-prevention data, and fraud-prevention data.
Payment and billing information, such as billing name, billing email, billing address, limited payment method details, subscription information, transaction history, payment status, invoice details, tax information, payment processor customer ID, failed payment information, chargeback or refund information, and School purchase or invoice status. We do not directly store full credit card numbers or full bank account details.
Communications and support information, such as contact information, message content, support details, screenshots or files you provide, account information relevant to support, communications history, security reports, privacy requests, copyright or DMCA notices, feedback, and feature requests.
Cookies and similar technologies, such as cookies, local storage, pixels, analytics tools, and similar technologies used to keep users signed in, authenticate users, remember preferences, maintain sessions, improve performance, prevent fraud and abuse, analyze Service usage, debug errors, measure feature adoption, improve the Service, understand marketing performance in adult-facing areas, and secure the Service.
4. HOW WE USE INFORMATION
We may use information to provide, operate, maintain, secure, support, and improve the Service; create, store, edit, regenerate, duplicate, assign, display, download, and export educational materials; generate AI content, answer keys, feedback, grading suggestions, Exports and Outputs, and related educational materials; provide online assignment features; display assignments to authorized Student Users; process student responses and submissions; provide teacher, parent, guardian, tutor, School, district, and admin tools; process uploaded or pasted source materials; manage accounts, authentication, subscriptions, credits, seats, licenses, rosters, and billing; process payments and prevent payment fraud; provide customer support; send service-related communications; monitor usage limits; detect, investigate, prevent, and respond to fraud, abuse, spam, security incidents, policy violations, and unlawful activity; debug, test, secure, and improve the Service; analyze trends and feature usage; develop new features and improve user experience; maintain backups and business records; enforce our Terms of Use; comply with legal, tax, accounting, security, and regulatory obligations; and protect the rights, safety, and property of EdFill, users, Student Users, Schools, service providers, and the public.
We may use de-identified, anonymized, or aggregated information for lawful purposes, including analytics, product improvement, security, reporting, research, fraud prevention, business operations, and Service development, provided such data does not reasonably identify an individual user, Student User, or School.
5. AI AND PROCESSING PROVIDERS
EdFill uses third-party AI, model, infrastructure, hosting, and processing providers to generate, analyze, transform, grade, evaluate, export, or process content.
Providers, models, features, configurations, data flows, and processing practices may vary depending on the feature used, user settings, School settings, account type, plan, integration, product configuration, and current Service functionality.
When you use AI-powered or AI-assisted features, we may send relevant information to these providers, including prompts, content, source materials, assignment content, student responses where authorized and necessary, instructions, requested output format, and metadata needed to complete the request. We do this to provide, maintain, secure, support, and improve the requested AI functionality and related Service features.
AI-generated content, answer keys, feedback, grading suggestions, explanations, images, diagrams, reading passages, Exports and Outputs, and other outputs may be inaccurate, incomplete, inappropriate, biased, outdated, or unsuitable for your intended use. Adult users are responsible for reviewing, verifying, and approving AI-generated or AI-assisted materials before using them with students or relying on them for educational decisions.
You should not submit sensitive personal information, unnecessary Student Data, confidential school records, protected health information, financial information, government identifiers, or other regulated data unless you have the legal authority to do so and accept responsibility for that submission.
6. STUDENT DATA, FERPA, COPPA, AND SCHOOL-CONTROLLED ACCOUNTS
When EdFill is used through a School account, the School controls Student Data submitted, generated, or maintained through that account, subject to our Terms of Use, this Privacy Policy, any applicable written agreement, user settings, School instructions, technical limitations, and applicable law.
Parents, guardians, and Student Users seeking access to, correction of, export of, or deletion of Student Data connected to a School account should contact the School directly. EdFill will use commercially reasonable efforts to cooperate with verified School instructions, subject to applicable law, security requirements, verification requirements, technical limitations, data retention practices, and any applicable written agreement.
Where FERPA applies and EdFill receives education records from or on behalf of a School, EdFill may act as a “school official” with a legitimate educational interest, under the School’s direction and control, solely for purposes of providing, maintaining, securing, supporting, and improving the Service for authorized educational purposes. The School is responsible for determining whether FERPA applies and for providing required notices, consents, or authorizations.
When a School, parent, guardian, educator, tutor, or other authorized adult allows a child under 13 to use student-facing features, EdFill relies on that School or authorized adult to provide or obtain any required consent or authorization under COPPA and applicable law. EdFill does not knowingly allow children under 13 to create independent, unsupervised accounts outside of a School-authorized, parent-authorized, guardian-authorized, or other legally authorized context. If we learn that we have collected personal information directly from a child under 13 without required authorization, we will take reasonable steps to delete that information.
Subject to the foregoing, EdFill may use Student Data to provide, maintain, secure, support, improve, and operate the Service; support assignments and student-facing features; authenticate users; manage accounts, classrooms, rosters, roles, permissions, and access; process student responses, submissions, progress, and feedback; provide support; troubleshoot issues; prevent fraud and abuse; enforce agreements; comply with legal obligations; maintain backups and business records; and create de-identified, anonymized, or aggregated data.
EdFill does not knowingly sell Student Data, use Student Data for targeted advertising to Student Users, build advertising profiles of Student Users, or disclose Student Data except as described in this Privacy Policy, the Terms of Use, an applicable written agreement, user settings, School instructions, or as required or permitted by law.
Schools and authorized adults are responsible for providing required notices, obtaining required consents, maintaining accurate rosters, managing Student User access, removing inactive Student Users, requesting deletion of Student Data no longer needed, configuring privacy and classroom settings, and ensuring their use of EdFill complies with FERPA, COPPA, state student privacy laws, school policies, district policies, procurement rules, and other applicable requirements.
Certain School, district, state, institutional, or student privacy requirements may require additional terms. EdFill may provide or require a Student Data Privacy Addendum, Data Processing Addendum, School Agreement, District Agreement, state-specific addendum, order form, or similar agreement. If there is a conflict between this Privacy Policy and a signed written agreement between EdFill and a School or district, the signed agreement controls to the extent of the conflict.
7. HOW WE DISCLOSE INFORMATION
We may disclose information to service providers and subprocessors who help us operate the Service, including AI, hosting, infrastructure, analytics, payment, authentication, integration, support, security, export, and processing providers. These providers may process information as necessary to provide services to us or as otherwise permitted by their agreements and applicable law.
We may disclose prompts, source materials, educational content, assignment content, student responses where authorized and necessary, and related metadata to AI or processing providers to generate, analyze, transform, grade, export, or process content through the Service.
If you use EdFill through a School, district, team, or organization, administrators may have access to information associated with your account or activity, including account status, roles, assignments, generated materials, submissions, progress, credit usage, seat usage, billing status, usage reports, and administrative settings.
We may display assignment content, responses, feedback, progress, and related educational activity to authorized teachers, parents, guardians, tutors, Student Users, Schools, and administrators depending on account settings and permissions.
We may disclose information if we believe disclosure is necessary or appropriate to comply with law, regulation, subpoena, court order, legal process, or government request; enforce our Terms of Use; protect our rights, safety, property, users, Student Users, Schools, Service, or business; detect, investigate, prevent, or respond to fraud, abuse, security incidents, or unlawful activity; protect students, children, users, or the public from harm; or defend against legal claims.
If EdFill is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, transfer of business, or similar transaction, information may be transferred or disclosed as part of that transaction. Where Student Data is involved, we will take commercially reasonable steps designed to require the recipient to protect Student Data in a manner consistent with this Privacy Policy, any applicable written agreement, and applicable law.
We may use and disclose aggregated, de-identified, or anonymized information for analytics, research, product improvement, business, marketing, security, reporting, Service development, and other lawful purposes.
8. COOKIES, ANALYTICS, AND ADVERTISING
We may use cookies, local storage, pixels, analytics tools, and similar technologies to operate, secure, analyze, and improve the Service. Essential technologies may be used for authentication, session management, security, fraud prevention, preferences, and core functionality. Analytics and performance tools may be used to understand usage, improve features, identify errors, measure performance, and make product decisions.
We may use marketing analytics or advertising tools in adult-facing areas of the Service, such as the public website, pricing pages, or marketing pages, to understand marketing performance and improve outreach.
EdFill does not knowingly use Student Data for targeted advertising, display targeted advertising to Student Users, or build advertising profiles of Student Users. If we use advertising or remarketing tools, we will take commercially reasonable steps not to use Student Data or student-facing areas of the Service for targeted advertising.
You may manage cookies through your browser settings. If you disable cookies, some parts of the Service may not function properly. Some browsers send “Do Not Track” signals. Because there is no uniform standard for responding to such signals, we may not respond unless required by law.
9. DATA RETENTION AND DELETION
We retain information for as long as reasonably necessary or permitted to provide, maintain, secure, support, and improve the Service; operate our business; comply with legal, tax, accounting, contractual, and regulatory obligations; resolve disputes; enforce agreements; prevent fraud and abuse; maintain security; preserve backups; and support legitimate business purposes.
Retention periods may vary based on account type, data type, plan, configuration, user settings, School settings, legal requirements, technical requirements, backup systems, and applicable written agreements.
Educational content, Exports and Outputs, and assignment content may be retained while your account or School relationship is active or until deleted, subject to backups, technical limitations, and legal retention. Student Data is retained as reasonably necessary for the educational purpose for which it was collected unless retention is authorized, required, or permitted by the School, parent, guardian, applicable agreement, applicable law, security needs, backups, legal obligations, or legitimate operational purposes. Deleted content may remain in backups, logs, or archival systems for a limited period. Payment, usage, support, security, and business records may be retained as needed for legal, accounting, security, fraud prevention, operational, and business purposes. Aggregated, de-identified, or anonymized data may be retained indefinitely.
Adult users may request account deletion by contacting privacy@edfill.com or through available account settings. Deleting an account may remove access to educational materials, assignments, Exports and Outputs, student-facing features, credits, subscriptions, and related materials. Users are responsible for exporting materials they want to keep before deleting or closing an account.
An authorized School administrator may request deletion of Student Data by contacting privacy@edfill.com. EdFill will use commercially reasonable efforts to delete or de-identify Student Data within a reasonable period, or within the period required by a written agreement or applicable law, except where retention is required or permitted for legal compliance, tax or accounting purposes, security, fraud prevention, backups, dispute resolution, enforcement of agreements, support records, audit logs, business records, de-identified or aggregated data, or other legitimate business, operational, technical, contractual, or legal purposes.
10. SECURITY AND SECURITY EVENTS
We use reasonable administrative, technical, and organizational safeguards designed to protect information. However, no internet service, software system, AI system, storage system, third-party service, or transmission method is completely secure. We cannot guarantee absolute security, and you use the Service at your own risk.
You are responsible for maintaining the security of your account credentials, devices, browser sessions, email account, administrator accounts, and authorized users.
If EdFill becomes aware of unauthorized access to or disclosure of personal information or Student Data maintained by EdFill, we will investigate and take steps we determine are reasonable and appropriate under the circumstances. Where required by applicable law or an applicable written agreement, we will notify affected users or Schools without unreasonable delay. Unless applicable law or a written agreement requires otherwise, the School is responsible for determining whether notice to parents, students, regulators, or other parties is required for Student Data connected to a School account.
11. PRIVACY RIGHTS AND CHOICES
Depending on your location and applicable law, you may have rights to access, correct, delete, receive a copy of, object to, restrict, or withdraw consent for certain processing of your personal information. You may also have the right to opt out of certain communications or appeal a privacy-rights decision where applicable.
To submit a privacy request, contact us at privacy@edfill.com. We may need to verify your identity before responding. We may deny or limit requests where permitted by law, including where information is needed for security, fraud prevention, legal compliance, accounting, dispute resolution, service operation, or protection of rights.
Parents, guardians, and Student Users seeking access to, correction of, export of, or deletion of Student Data connected to a School account should contact the School directly. EdFill will use commercially reasonable efforts to cooperate with verified School instructions.
We may send transactional and service-related emails, including account, verification, password reset, billing, subscription, security, assignment, policy, legal, and support communications. You may also receive optional marketing or product emails if permitted by law. You may opt out of marketing emails by using the unsubscribe link or contacting us, but you cannot opt out of necessary transactional, billing, legal, account, assignment, or security communications while using the Service.
12. CHILDREN’S PRIVACY
Student Users may access the Service only under the direction, authorization, control, or supervision of a School, parent, guardian, educator, tutor, or other authorized adult.
EdFill does not knowingly allow children under 13 to create independent, unsupervised accounts outside of a School-authorized, parent-authorized, guardian-authorized, or other legally authorized context. If we learn that we have collected personal information directly from a child under 13 without required authorization, we will take reasonable steps to delete that information.
13. STATE, REGIONAL, AND INTERNATIONAL DISCLOSURES
Residents of California and other states may have additional privacy rights under applicable privacy laws, depending on whether those laws apply to EdFill and your relationship with us. These rights may include the right to know, access, delete, correct, opt out of certain sales, sharing, or targeted advertising, limit certain uses of sensitive personal information, and not be discriminated against for exercising applicable rights.
We do not knowingly sell Student Data, use Student Data for targeted advertising to Student Users, or build advertising profiles of Student Users. If our practices change or if applicable law treats certain analytics, advertising, or third-party disclosures as a “sale” or “sharing,” we will provide required notices and choices where required by law.
Certain states may provide additional student privacy rights or requirements. Where required, EdFill may provide or enter into a Student Data Privacy Addendum, Data Processing Addendum, School Agreement, District Agreement, state-specific addendum, or other written agreement. Schools and districts are responsible for notifying EdFill if their use of the Service requires specific state-law terms, procurement terms, or contractual requirements.
EdFill is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, or processed in the United States and other countries where we or our service providers operate. These countries may have privacy laws different from those in your jurisdiction. By using the Service, you understand that your information may be transferred and processed outside your country of residence.
14. THIRD-PARTY LINKS, SERVICES, AND EXPORT DESTINATIONS
The Service may contain links to third-party websites, services, tools, integrations, export destinations, or resources. We are not responsible for the privacy practices, security, content, policies, availability, compatibility, or actions of third parties. Your use of third-party services is governed by their terms and privacy policies.
15. DATA ACCURACY
You are responsible for keeping your account information accurate and current. Schools, parents, guardians, educators, tutors, and authorized adults are responsible for keeping rosters, Student User access, classroom information, assignment settings, export destinations, and related information accurate and current.
We are not responsible for issues caused by inaccurate account information, outdated email addresses, incorrect billing details, unauthorized access, stale rosters, incorrect student assignments, or incorrect export destinations caused by user or School error.
16. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes to our Service, features, data practices, legal requirements, providers, integrations, export features, school features, student-facing features, or business operations.
If we make material changes, we may notify you by posting the updated Privacy Policy, updating the effective date, sending an email, requiring in-app acceptance, or providing other notice, as appropriate or required by law. Your continued use of the Service after the updated Privacy Policy becomes effective means you acknowledge the updated policy.
